By accessing or using SMC Converter ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. About the Service
SMC Converter is a digital file conversion platform that allows users worldwide to upload files and use purchased Coins for conversions. The Service is operated by SayMC.
2. Eligibility
- You must be at least 13 years old.
- Users under the local age of digital consent must have parental permission.
- By using the Service, you confirm you meet these requirements.
3. User Accounts
- Creating an account is required to purchase Coins and perform conversions.
- Users are responsible for account security and login credentials.
- Accounts may be suspended or terminated for violating these Terms.
4. Coins & Digital Purchases
- Coins are the virtual currency used to purchase conversions on the Service.
- Coins are non-refundable, non-transferable, and have no cash value.
- Coins may be revoked if accounts are abused or Terms are violated.
- Coins cannot be sold or exchanged outside the Service.
5. No Refund Policy
- All purchases are final. No real-money refunds will be issued.
- In case of a failed conversion caused by a Service error, Coins may be returned at the discretion of SMC Converter.
- Coin refunds are the only refund method; cash refunds are not available.
- Failed conversions caused by user error, unsupported files, or misuse are not eligible for Coin refunds.
6. File Uploads & Conversion Accuracy
- Users are fully responsible for the files they upload.
- Conversion results are not guaranteed. Files may be corrupted, incomplete, or incompatible.
- The Service is provided AS IS with no warranties.
- Files are stored temporarily only for processing and may be deleted automatically after conversion.
7. User Responsibilities
Users may not:
- Upload illegal, harmful, or copyrighted content without permission
- Upload malware or malicious files
- Attempt to hack, overload, or exploit the Service
- Abuse the conversion system or Coins
- Attempt fraudulent chargebacks or payment manipulation
Violation may result in account termination and loss of Coins.
8. Limitation of Liability
To the maximum extent permitted by law:
1. The total liability of SMC Converter and SayMC for any claim is limited to the lesser of:
- The total amount paid by the user to SMC Converter, or
- $20 USD
2. SMC Converter is not liable for:
- Lost or corrupted files
- Failed conversions
- Downtime, outages, or Service interruptions
- Indirect, incidental, or consequential damages
- Loss of profits, opportunities, or finances
- Damages resulting from user error
Users accept full responsibility for using the Service.
9. No Warranty
The Service is provided "AS IS" and "AS AVAILABLE." SMC Converter does not guarantee:
- Perfect conversions
- Continuous uptime
- Bug-free operation
- Compatibility with all devices or software
10. Account Termination
SMC Converter may suspend or terminate accounts for:
- Violating Terms
- Fraud, chargebacks, or abuse
- Uploading illegal or malicious files
- Exploiting the system
All Coins will be forfeited upon termination. No refunds.
11. International Access
The Service is available worldwide. Users are responsible for complying with their local laws when accessing the Service.
12. Governing Law
These Terms are governed by the laws of the jurisdiction where SayMC operates SMC Converter. Disputes will be handled in that jurisdiction, regardless of the user's location.
13. GDPR Compliance
For EU/EEA users, the Service complies with GDPR:
- Users may request access, deletion, or correction of their personal data.
- Users may contact SayMC at smcconverter@gmail.com for data-related requests.
- Files are stored temporarily for processing only.
- Coin purchases and account data are retained for accounting and fraud prevention purposes.
14. Changes to Terms
SMC Converter may update these Terms at any time. Continued use constitutes acceptance of any updates.
